RICHARD TOWNSEND, called as a witness was sworn and examined, testified as follows:
DIRECT EXAMINATION
BY MR. SMITH:
Q Please state your name and address for the record.
A Richard Townsend, I live at 632 John Street in New Castle.
Q You're incarcerated in the Beaver County Jail before I brought you up a couple days ago?
A Yes.
Q Do you know Jay William Buckley?
A Yes.
Q Do you currently have any Warren County charges pending against any of you of any kind?
A No, I don't.
Q I interviewed you on Sunday of this week; is that correct?
A Yes.
Q Did I make any threats or promises to you at any time?
A No.
Q Were you in the Beaver County Jail - - let me ask you this: Do you have a prior record of any kind?
A I have a D.U.I. that I am in jail for.
Q Do you have anything other than the D.U.I. that

you're in jail for?
A No.
Q Were you in the Beaver County Jail during the time that Mr. Buckley was incarcerated there picking this jury?
A Yes, sir.
Q And was Mr. Buckley on your range or block so to speak?
A Yes, he was.
Q How many bunks were in the range?
A There was four cells and there was two bunks and a cot in between the bunks.
Q Was it a small area?
A It had double bunks.
Q Was it a smaller area or a big area?
A Small area.
Q In feet approximately?
A Feet approximately from here to those banisters, from one end to the other.
Q If some one said from here to the windows, would that be - -
A That's too far.
Q Were all four cells in this area that you're describing?
A You had four cells they're roughly six feet wide, so you run one, two, three, four, a shower, a space of

maybe this far outside, the cells to the bunks, you had like a set of double bunks here, set of double bunks in the corner where the shower and cot is in the middle is where Buckley slept.
Q When Mr. Buckley was there what did he do when you observed him?
A He just basically was pretty quiet, he played some cards with the guys, he used up where my cell is in Number One the telephone, he used to get on the telephone and talk to his girlfriend a lot.
Q Did he discuss - - who did he appear to be good friends with?
A Actually basically nobody, he got in card games and he talked a little bit, but he pretty much kept to himself, he didn't say too much.
Q Did he seem to be good pals with a Mr. Piuri?
A I would say no.
Q Did you ever see him go in Mr. Piuri's cell and they have a private conversation together, things like that?
A No, I did not.
Q No?
A No, I did not.
Q Did you ever see Buckley talking any way about the

Kathy Wilson murder case or any charges he had against him while he was there?
A No, sir, I did not.
Q Did he mention to you that he was picking a jury in Beaver County?
A Yes, he did. I'm sorry, I am not for sure he said that because we got the newspaper and we kind of knew that that's what he was down there for, so I can't say positively that he said that, but it was pretty well known.
Q Did you have any discussion with him about the case at all?
A No.
Q Did you overhear any discussion him talking about the case with any one else in the range?
A No.
Q If he was talking or having a private conversation, given the size of the range, would you at least overhear or see it?
A It would be something - - it wouldn't have been something that you could miss too easily, it's just too small in there and there's no place to hide in there without people seeing it.

CROSS EXAMINATION
BY MR. MASSA:

Q If I had a quite (sic) conversation with the gentleman seated to my right, are you saying we couldn't talk without your overhearing?
A No, I'm not going to say that.
Q You certainly aren't saying that Mr. Buckley exclusively spent his time with a Robert Gibson or with yourself or with others, other inmates, than Peter Piuri?
A No.
Q Did Mr. Buckley ever tell you the nature of the charges that he was facing?
A I don't recall him telling me that, no.
Q So if he made a statement to Gibson he could have had a conversation with Gibson without your overhearing it?
A It's possible, yes.
Q If he had a conversation with Gibson without your overhearing it, he could have had a conversation with Piuri without your overhearing it?
A That is possible, yes.
