TAMARA JAMES, called as a witness was sworn and examined, testified as follows:
DIRECT EXAMINATION
BY MR. SMITH:
Q Would you Please state your name and address for the record?
A Tamara James, 218 Fairmount Avenue, Jamestown.
Q Do you know Michael Brown?
A Yes.
Q And how do you know Michael Brown?
A He came to a party one night at Bridgett Phillips' house.
Q Do you know approximately what time, what month or year the party was?
A Winter 1989, I was in school in 1988 and Bridgett

moved there at that time after I graduated.
Q So it would have been the winter of 1989?
A Yes.
Q Do you know Jay Buckley?
A No.
Q Never met him before?
A No.
Q At the party did Mr. Brown talk at all about the Kathy Wilson case?
A Yeah.
Q Did he indicate that he had given various statements to the police?
A Yes.
Q Did he make jokes about that?
A Yes.
Q Did he tell you at that party in the winter of 1989 that he knew where Kathy Wilson's body was?
A In a field, but nothing specific.
Q In a field?
A Uh-huh.
Q What was his condition at the time he was telling this story?
A He had been drinking when he got there and them he left and got more to drink, so he had been drinking.
Q Was he bragging about Kathy Wilson at all?

A Basically, he was talking about her picture, I don't know who she was, he said, "Hadn't you seen her picture?".
Q Did he say - - he said she was in a field, did he describe how her body was found? (Sic)
A After we laughed at him he said she would be found without her head.
Q In a field without her head?
A Yes.
Q That was after you laughed at him?
A Yes.
Q Did he bring Mr. Buckley's name up at all?
A No.
Q None?
A He didn't bring any names up.
MR. SMITH: No further questions, Your Honor.
CROSS EXAMINATION
BY MR. MASSA:
Q Is it Miss James?
A Yes.
Q When did this conversation take place?
A At the party that evening.

Q When, not where?
A Oh, 1989.
Q January of 1989?
A Yeah, well, it was snowing outside and he was telling us about a confrontation with police.
Q Was this prior to his arrest?
A I don't. (Sic)
MR. MASSA: No further questions.
MR. SMITH: I call Daniel Drake to the stand by way of telephone deposition.
MR. MASSA: Your Honor, may counsel approach the bench, please?
(Whereupon, there was a sidebar discussion off record.)
MR. SMITH: Your Honor, I advise the jury that last night about 8:00 we took a telephone deposition of a witness for the Defense and the gentleman is located in the State of Florida and it would be inconvenient and expensive to have him come here so pursuant to a Stipulation by the Commonwealth and Defense we met in my office and called Mr. Drake up and put it on speaker hone and there was a Court Reporter present who swore him in, placed him under oath, and took down his testimony which we now have and we're going to read our respective parts, what questions we asked and Mr. Rapp here is going to be Mr. Drake.
