Testimony of Janet Sherlock on Thursday, May 29, 1991. Ms. Sherlock was an employee of a pet store at the Chautauqua Mall. She testified concerning her assisting a woman similar in appearance to Kathy Wilson on May 18, 1988.

JANET SHERLOCK, called as a witness was sworn and examined, testified as follows:

DIRECT EXAMINATION

BY MR. SMITH:

Q Please state your name and address for the record.

A Janet Sherlock, 550 Bigelow Avenue, Jamestown, New York.

Q Mrs. Sherlock, where are you employed?

A Currently?

Q Currently.

A Century 21.

Q In Jamestown.

A Yes.

MR. MASSA: Your Honor, May Counsel approach the bench?

Q On May 18, 1988 where were you employed?

A General Store for Pets, Chautauqua Mall.

Q The Chautauqua Mall?

A Yes.

Q On May 18, 1988, did you have an occasion to observe a woman who come into your store?

A Yes.

Q And could you describe her?

A Well, when I came on the sales floor there was a woman standing there, I went over and asked if I could help her, she was about five eight, approximately early 30's, blond hair, she had on a tan or beige business suit, a light colored button front blouse, she had her purse with her and she also had a bank bag.

Q A bank bag?

A Yes.

Q Do you know what color the bank bag was?

A No, I don't remember that.

Q Was she talking to anyone?

A She did talk to someone later. I had helped her and during the course of while I was helping her a gentleman was in the store and she turned around and they recognized each other and they carried on a very short conversation, just a few sentences to each other acknowledging enough to let me know that they knew each other and that was it and I continued helping her and the gentleman left.

Q What race was the gentleman she was talking to?

A He was black.

Q Do you know Jay William Buckley?

A Personally? No.

Q Did you see him on May 18, 1988?

A No.

Q Did she tell you what she wanted at the store?

A She wanted a dog bed.

Q Did she buy a dog bed?

A No.

Q Did you have a conversation with her concerning dog beds?

A Yes, I did. I helped her, I got up on the ladder and brought several beds down for her to look at and we discussed the size of the dog and she decided at this time that - - she acted rather rushed, she said she didn't want

to pursue it any further and that it was her husband's dog and she would like him to come in and pick out the dog bed and after that she left.

Q You've been interviewed by the police numerous times?

A Yes, I have.

Q They showed you a picture of Kathy Wilson?

A Yes.

Q You identified the lady as being the lady you talked to?

A Not beyond a reasonable doubt, no.

Q Up until two, three weeks ago, was it your understanding that you were going to be a Commonwealth witness in this case, that they were going to subpoena you for trial?

A I didn't know until I actually got the subpoena, which was two or three weeks ago, but I wasn't told beforehand that they were gong to.

Q Well, we subpoenaed you, let's make no mistake about that. Were you under the impression that you were going to be called to trial as a witness for the Commonwealth?

A No.

MR. SMITH: No further questions.

BY MR. MASSA:

Q Mrs. Sherlock; is that correct?

A Yes.

Q I just have a few questions. As a matter of fact, you never received a subpoena that said that it was from the Commonwealth of Pennsylvania; did you?

A I received a subpoena that said that it was for the Defense.

Q Thank you.

A I am not familiar with what the Commonwealth means, so it was for the Defense.

Q Okay. You were shown posters, photographs, et cetera and at no time - - of Kathy Wilson, is it not correct at no time could you identify the person that you have described definitively as being Kathy Wilson?

A Not absolutely, no.

Q Thank you.

MR. MASSA: No further questions.

MR. SMITH: Nothing further.

THE COURT: You may step down.

MR. SMITH: I call Robert Anderson to the stand.
