MR. SMITH: I call Carolyn Smith to the stand.
MR. MASSA: May we approach the bench?
(Whereupon, there was a sidebar discussion off record.)
CAROLYN SMITH, called as a witness was sworn and examined,

testified as follows:
DIRECT EXAMINATION
BY MR. SMITH:
Q Will you state your name and address for the record?
A Carolyn Smith, I live at 239 Sprague Street, Jamestown.
Q What do you do for a living?
A I am a manager for A Plus Convenient Mini Markets.
Q Did you know Kathy Wilson and Mark Wilson?
A I knew Kathy, I know of Mark.
Q You know of Mark, but you knew Kathy?
A Yes.
Q How did you know her?
A Her daughter played on the same softball team with my daughter.
Q Would you go to the same games as Kathy?
A We were always there at the same time.
Q I want to draw your attention to May 17, 1988, were you at a softball game that night?
A Yes.
Q Was Kathy Wilson there?
A Yes.
Q Was your daughter and her daughter there?
A Yes.
Q Was Mark Wilson at the game?

A Yes, not at the game, I mean he was there.
Q Where did he sit?
A He didn't sit, he stood behind the catcher's mound behind the fence.
Q Where were you sitting?
A On the bleachers>
Q Where were you sitting in relationship to Kathy Wilson?
A I think she was sitting a row behind me.
Q Did you notice anything unusual concerning Kathy Wilson and Mark Wilson on that evening?
A Yes, because I have never seen Mark at a ballgame before.
Q He usually didn't come?
A No, Kathy was always there. It was brought to my attention by the coach of the team, I was sitting with his wife, your coach's wife and with the other parents there and he come over and he told us, he says, "Look over there". Mark Wilson was standing behind the fence, his hand up on the fence staring at - - not staring, glaring at Kathy?
A Yes.
Q What do you mean by glaring?
A It was a look that has haunted me since Kathy disappeared.

Q Could he just be looking over there that way when you looked over?
A No.
Q Why not?
A Because every one was looking at him.
Q Everybody was looking at him>
A It made the coach very uncomfortable, he thought something was going to happen.
Q What did you think was going to happen?
A I didn't know because I don't know Mark Wilson that well.
Q Mark Wilson ever come over and sit down behind Kathy that night?
A No. No.
Q Do you know anything more about the incident at the ballfield?
A No, he was there for about 15 minutes and left.
Q He left before she did?
A Oh, yes.
Q Never said a word to her?
A No.
Q Did he glare at her the whole time he was there?
A Yes.
Q The whole time?
A The whole time.

CROSS EXAMINATION.
BY MR. MASSA:
Q Where did this take place?
A Shadow Point Park.
Q How any ballfields are at Shadow Point Park?
A Just the one we used.
Q Are there not several fields within this complex?
A Yes, I believe so. I believe so, but there was just the one that the girls used.
Q How many ballfields are at Shadow Point Park?
A There is two down at the lower end, the one up in the back where - -
Q Were there other games going on at the other facilities?
A Not that I know of.
Q Not that you know of. Could there have been?
A There could have been.
Q What were you doing for the 15 minutes that you observed what you say you observed?
A Trying to watch the ballgame.
Q Were you glaring at Mark Wilson?
A No.
Q What was he wearing.
A If I am not mistaken, I think he had a blue jacket on

that night. I am not really positive, it's been three years, but the look on his face is what made me remember.

MR. SMITH: Nothing further.

A I am a construction worker.
Q You're not related to me; are you?
A No.
Q We just share the last name. Do you know Jay Buckley?
A Never seen him before in my life.
Q You're Carolyn's husband?
A Yes.
Q Were you at a ballgame on May 17, 1988?
A Yes.
Q Did you have an opportunity to see Kathy Wilson at the ballgame?
A Yes, in fact my wife was sitting with her, I was
