RECANTING STATEMENT OF:Scott Boyer
On the night of July 28th and the morning of July 29th 1986. I was at the Kwik Fill gas station on the east side of Warren. On this particular night/early morning Gary Lauffenberger was to have assaulted Joe Zdarko. The people who had written statements agaist Gary Lauffenberger had been drinking and some were intoxicated. Me, Joe and some friend had just returned from a beer party when the incident had taken place. Me and Joe went into Kwik Fill to get something to snack on. When we came back out to the parking lot we seen one of the guys that was at the party with us across the street argueing with Gary Lauffenberger. Me, Joe and a couple of friends went over to see what was going on.
When Gary seen that he was out numbered,
he fled from the seen.
We where almost back to the Kwik Fill parking lot when around the buiding came Gary,
he was holding a rifle of some kind. He came across the street after us. Joe hid between two cars and I hid on a small embankment about 10 to 15 feet away from Joe. Gary came over to the two cars where Joe was hiding. Joe started pleading for his life. Gary then told Joe to get the fuck up and get outta there. As Joe was leaving Gary said maybe next time you will not gang up on someone.
I was the closes to Joe and Gary and there is no way to know if Gary hit Joe with the gun.
Joe did have a
small red mark
on the back of his head
but that could had happened earlyier when Joe fell a couple of times because he
had to much to drink.
After Gary left Joe told his friends to say that they saw Gary hit him because Joe was planing to sue Gary.
