You're scheduled to see the Parole Board next month (11 - 14 - 89). You are elegible according to the Parole Act in Pennsylvania for parole on your minimum. You will be granted an individual interview before the Board member. Your questions were answered at the parole education class held on 9/28/89 which you did not attend.

Thank you for your prompt reply to my previous request (10-18-89).
The reason for that request was that I had been informed thru what I consider a reliable source, of
a statute which states that a prisoner whose minimum sentence exceeds one-half of his maximum sentence is elegible for parole at one-half of his maximum sentence. I have so far been unable to locate such a statute
and would inquire whether you are aware of any such statute, directive, etc?
I realize it is rather late to straighten this out now, but I am quite upset that everyone (staff) seems to acknowledge that mine is an illegal sentence, yet insist on proceeding on the basis that my min. date is Jan.- 90 rather than Jan. -89, and I'd like to know your superiors position on this.

The Parole Board does not set minimum and maximum dates. That is done by Records Office through the Department of Corrections.
From what I was told your two sentences which were legal were aggregated and that this is permissible. I can do nothing, nor my Supervisor. I would suggest you write your counselor or Records Office concerning this.

I consider this an urgent matter as it involves an error on the part of the Dept. of Corrections in interpreting my sentence
which has resulted in my being nearly one year over my legal minimum sentence.
I have statutory proof of this fact showing my minimum date to be

On 12-18-89, I saw you in my office for an informal counseling session in which you reluctantly admitted an alcohol problem but saw no need for further treatment. This lack of motivation for treatment was pointed out to you by me, and you were informed that this made you inappropriate for Level III particapation. I also asked you to think about our session and contact me if there are any changes in your attitude. Thus far this has been your only request, and again I point out, that this is a request for an explanation not a request for treatment.

OR I have received no information from Records Office concerning change in your minimum sentence. I do not have your Board action as of yet. They are taking 4-6 weeks to return. Attached is a copy of a letter to you from our central office indicating the adjustment in your sentence, if appropriate, needs to be handled by the Records Office.
